Terms & Conditions
By signing up to the Open Innovation Challenge (hereinafter referred to as "Challenge"), the Participant agrees to the present Terms & Conditions (hereinafter referred to as "Term & Conditions").
All the Platform content is of non-confidential nature and open to all points of view on intended diabetes-related topics. However, Diabetes Center Berne (hereinafter referred to as "DCB") reserves the right to remove any post or reply that includes derogatory, abusive, offensive, obscene, violent, inappropriate, or inaccurate content of any kind.
Participants shall interact with other Participants respectfully, as the Participants would do in any professional setting. Hate speech, discriminatory remarks, intimidating behaviour or posts, or any abuse of the platform may also constitute grounds for participant's immediate removal from the Challenge. All decisions pertaining to participants and ideas admitted or selected for any stage of the Challenge including the final selection and winning proposals are final.
While all efforts are undertaken to prevent this, DCB cannot fully rule out unplanned downtime of any online or offline service for or connected to the Challenge.
All contents and comments to other discussions must be provided in English to ensure an efficient communication between all Participants participating in the Challenge
Acceptance of these Terms & Conditions are prerequisite for participating in the Challenge.
II. Data Privacy
DCB collects Participant's first name, last name and email address to make sure participants do not miss any important updates / deadlines and keep informed about news, events, trainings, mentorings, votings and peer chats on the platform.
By using the Platform, the Participant gives his/her consent to DCB and its service provider for the hosting of the Platform to hold and use his/her personal data. All personal details and information that relate to an identified or identifiable person ("personal data") qualify as personal data. In addition to your contact data such as name, telephone number, address or e-mail address, personal data also includes the IP address, payment data and other information such as the pages viewed and reactions to offers displayed on our website.
The Participant also agrees by using the Platform and profiting from DCBs services and expertise, that his/her contributions are made available to the public through the Platform and DCBs communication channels with his/her name and/or username as well as his project idea, without any financial compensation.
The Participants are authorized to use the Challenge for own PR activities. The name "DCB Innovation Challenge" must be mentioned. Moreover, the Participants may use the DCB logo in this context. This is available at www.dcberne.com

What Are Cookies?

III. Intellectual Property Rights
The entire content Platform (website) is subject to copyright (and related Intellectual Property Rights) with all rights reserved by DCB.
The Participant ensures to the best of his/her knowledge that the submitted ideas, materials and information are neither of confidential nature nor unlawfully obtained by the Participant.
DCB aims at living the idea of open innovation and supports the dialogue between Participants as well as with DCB experts, coaches, and mentors. DCB does not aim at taking over intellectual property rights from Participants.
DCB can use Participant's contributions in any way and for any purpose including to display, publish, broadcast, transmit, or communicate to the public by any means, known or unknown and distribute Participant's contributions for the whole duration of the protection granted to intellectual property rights by applicable laws and international conventions.
Participant may continue to share and promote Participant's work on Participant's own website, online profiles, etc. during and after the challenge. Participant may not sell any items, whether physical or digital, related to the ideas submitted on the Platform during the Challenge.
Should DCB choose to no longer consider Participant's idea(s) for the Challenge, by way of refusing the submissions to the site, deleting or archiving submitted ideas, or denying Participant's idea(s), DCB will retain the non-exclusive right to display Participant's idea(s) on the Platform and in promotional materials related to the Platform worldwide, and release back to the Participant any remaining rights that Participant assigned at the time of submitting the idea(s).
The Participant bears his/her own expenses resulting from his/her participation in the Challenge. DCB shall not be obliged to pay any compensation (of whatever nature) to the Participant in connection with the participation in the Challenge.
IV. Disclaimer / Liability
DCB declines all liability whatsoever for loss or damage of any kind that a Participant or any third parties may incur in connection with access to or use of the platform or parts thereof, or from links to third parties' websites. Anyone visiting the platform, using the information contained therein, or availing themselves of the offers featured therein does so at their own risk and responsibility.
DCB also declines all liability for lost earnings, for Internet-related malfunctions of all kinds (e.g. suspension of operations, disruption of functions, viruses, pernicious components, terrorist acts, etc.), for misuse by third parties (hacking into data, copying, etc.) and for loss of programs or other data in your information systems. This applies even when the Platform might indicate the possibility of such damage.
V. Linked websites
Links on the platform may lead to third parties' websites which are outside the control of DCB. DCB cannot accept responsibility for the correctness, completeness, or lawfulness of the content of these websites or of any links to further websites, nor for any offers, products or services contained therein. Users access the linked websites at their own risk.
By signing up to the Challenge, the Participant agrees to the present Terms & Conditions.
VI. Applicable law and jurisdiction
All disputes arising in association with these Terms and Conditions shall be governed exclusively by Swiss law.
Place of jurisdiction shall be Berne, Switzerland. DCB may also take action against the Participants at their place of residence or business headquarters. German shall be the official language for dealing with all disputes.
When registering on our site, as appropriate, you may be asked to enter your name, email address or other details to help you with your experience.
